  2. Online store  www.aleksandrawiniarska.com operates under principles specified in the Regulations.
  3. Regulations determine types and scope of services provided electronically by the online store www.aleksandrawiniarska.com, principles of service provision, conditions of concluding and terminating electronic services agreements and Product Sales Agreement.
  4. Whenever the Customer decides to use electronic services of the online store www.aleksandradrawiniarska.com, he is obliged to read and accept the Regulations.
  5. The placing of an order implies familiarization and acceptance of the Regulations
  6. Online store www.aleksandrawiniarska.com runs retail and warehouse sales via the Internet all over the world.
  7. Products offered for sale  in the online store are new, free from legal defects.


  1. WORKING DAY – any day Monday through Friday, excluding banking holidays
  2. REGISTRATION FORM – form available on the website  www.aleksandrawiniarska.com enabling the Customer to create   and Account.
  3. ORDER FORM – form available on the website  www.aleksandrawiniarska.com enabling the Customer to create and Account
  4. CONSUMER –  natural person, who concludes a legal transaction with an entrepreneur, which is not directly related to his business or  an occupational activity.
  5. CLIENT – Customer who intends to conclude or who has concluded Sales Agreement with the Seller.
  6. ACCOUNT – Service Provider’s collection of resources in ICT system which has an individual name (login) and is  protected by a password, where Customer’s data are gathered, including the ones related to a placed order.

  9. SELLER, SERVICE PROVIDER  –Aleksandra Bartus-Winiarska, place of business and mailing address: 55 Lady’s Cross, Clonakilty, Co.Cork, Ireland.
  10. PRODUCT– a movable asset available in the online store being the subject of Sales Agreement made between the Customer and the Seller.
  11. SALES AGREEMENT  – Product Sales Agreement made between the Customer and the Seller via the online store.
  12. CUSTOMER – natural person, legal person or an organizational unit without legal personality, which obtains the legal capacity under the Act,  using the Electronic Service.
  13. ELECTRONIC SERVICE – service provided electronically by the Service Provider for the Customer via the online store.
  14. ORDER – Customer’s declaration of will being Product Sales Agreement offer with the Seller.
  15. NEWSLETTER – Electronic service enabling the Customer to subscribe and receive free information provided by the Service Provider concerning products available in the online store, sent to the address provided by the Customer


  1. Service Provider via the online store makes it available to use the following Electronic Services

  2. keeping an Account in the online store
  3. using Newsletter
  1. Provision of Electronic Services for Customers in the online store takes place under conditions determined in the Regulations.
  2. Service Provider reserves the right to  place advertisements on store’s website. Such advertisements shall be an integral part of the  online store and materials presented in the online store.


  1. Provision of Electronic Services specified in chapter III point 1 of Regulations by the Service Provider is for free of charge.
  2. Term for which, the agreement is being concluded:
  1. Electronic Service Agreement consisting in  keeping an Account in the online store is concluded for a unspecified period of time
  2. Electronic Service Agreement consisting in placing an Order in the online store is concluded for a specified period of time and terminated the moment an Order is placed or if the Customer decides not to continue placing an Order.
  3. Electronic Service Agreement  consisting in using Newsletter is concluded for an unspecified period of time.
  1. Technical requirements necessary with respect to ICT system, used by the Service Provider
    1. computer with Internet access
    2. access  to e-mails
    3. Internet search engine
    4. enabling  Cookies oraz Javascript.
  2. Customer is obliged to use the online store in line with law and good practice, considering the respect for personal rights and third persons’ intellectual property rights.
  3. Customer is obliged to enter data in conformity with factual circumstances
  4. Customer is prohibited from providing texts of unlawful  nature


  1. Information available on  the online store sites does not constitute an offer within the meaning of the provisions of laws. Customer placing an Order, places a purchase offer of a specific Product under conditions included in its description.
  2. In the event a part or all Products included in an Order are unavailable , the Customer is informed about it by e-mail or by phone and his decision further processing will be requested ( Order cancellation, processing without out of stock Products, further waiting time for processing, selection of other Product instead of the one which is out of stock).
  3. Product’s price visible in the online store is given in euro ( EUR) and contains all components, including customs and other components. The price does not included delivery costs.
  4. Product’s price visible in the online store is binding the moment the Customer places an Order. The Price shall not be changed regardless of price change made in the online Store, which may appear  with respect to particular Products after the Order is placed by the Customer.
  5. The Customer does not have to register in the online store to place an Order.
  6. Orders can be placed

  1. Online store processes Orders Monday through Friday during its working hours, that is 9.00 a.m. until 5 .00 p.m. Orders placed on business days after 5 p.m., on Saturdays, Sundays and banking holidays shall be processed the next Business Day.
  2. Concluding Sales Agreement
    1. The Customer needs to place an Order by methods made available by the Seller in order to conclude Sales Agreement.
    2. After placing an Order, the Seller shall immediately confirm its receipt, which means that an Order placed by the Customer is a binding one for him. Order confirmation receipt is done by sending an e-mail including:
      • confirmation of all relevant Order’s elements
      • online Store’s declaration of Order receipt
      • online Store’s declaration of Order acceptance
      • information if it is necessary for the Customer to pay an earnest money for the Order placed in the amount of 20% of the total amount of the Order
      • declaration of right of withdrawal from an agreement
      • instruction on the right of withdrawal from an agreement
      • the  Regulations
    3. The moment  the Customer receives an e-mail mentioned in point 8, Sales Agreement is deemed made between the Customer and the Seller.
  3. Each Sales Agreement shall be confirmed by a proof of purchase, attached to a delivery.


  1. The Seller offers the following methods of payment:

  1. In the event  payment is made via  online payment systems, the Customers makes payment prior to Order processing. As far as electronic payment systems are concerned, one may pay by a credit card or use Fast Cash. Product will be shipped after payment is made.
  2. The Customer is obliged to make payment under Sales Agreement within the period of 7 Business Days as of the date of conclusion, unless Sales Agreement provides otherwise. In case of non-payment within the specified period, an Order shall be cancelled.


  1. Product delivery costs are determined during the process of Order placement and are subject to method of payment and method of delivery of  the purchased Product..
  2. Products purchased from the online store are sent by  a courier.
  3. For Order of value at least 200 euro, the Seller obliges himself to cover the delivery costs.
  4. Product delivery date encompasses time necessary for Order picking and Product delivery time by a carrier.
  1. Product picking time is 2-3 Business Days.
  2. Product delivery by  the Courier is made within the period declared by him that is from 12 to 14 Business Days ( order is made only during Business Days, excluding Saturdays, Sundays and public holidays)


  1. Electronic Service Agreement termination:
  1. Permanent and indefinite-term Electronic Services Agreement    ( e.g.  running and Account) may be terminated
  2. Service Provider may terminate the Agreement  with  an immediate effect without a reason by sending a relevant declaration via e-mail abwiniarska@yahoo.com
  3. Service Provider may terminate permanent and indefinite- term  Electronic Service Agreement if the Customer violates the Regulations, particularly if  he provides unlawful content after the ineffectual earlier cease and desist letter with an indicated term. In such case, the Agreement expires after 7 days as of the date of submitting a declaration of  intent to terminate it ( notice period)
  4. Termination results in discontinuation of relationship effective ex nunc.
  1. Service Provider and  Customer may terminate  Electronic Service Agreement at any time  in a way of settlement between the Parties.


  1. Statutory warrant complaints
  1. Notice of defects concerning the  Product and complaint notification may be made via e-mail  : abwiniarska@yahoo.coml or in writing to the following address:55 Lady’s Cross, Clonakilty, Co.Cork, Ireland
  2. Customer should contain in his e-mail as much information and circumstances as possible  concerning  the subject of complaint, particularly type and date of occurrence of abnormality and contact data. Provided information will facilitate and accelerate the complaint handling by the Seller. 
  3. If it is necessary to assess Product’s physical defects, one needs to send it to the following address:  55 Lady’s Cross, Clonakilty, Co.Cork, Ireland
  4. The Seller shall immediately take an attitude towards Customer’s claim, not later than within 14 days.
  5. In case of failure to handle a complaint filed by Customer being Consumer within 14 days, such complaint shall be deemed recognized.
  6. Complaints regarding difference between an appearance of the Product ordered with an appearance of the Product received, which result in Customer’s screen   parameters, particularly difference in colours and shades of materials the Product is made of, do not provide the basis for complaint. 
  1.        Complaints related to the provision of Electronic Services by the Service Provider:
  1.  Customer may file complaints related to the provision of Electronic Services through the online Store via e-mail,: abwiniarska@yahoo.com
  2. Customer should contain in his e-mail as much information and circumstances as possible  concerning  the subject of complaint, particularly type and date of occurrence of abnormality and contact data. Provided information will facilitate and accelerate the complaint handling by the Seller.  .
  3. The Seller shall immediately take an attitude towards Customer’s claim, not later than within 14 days.
  4. Service Provider shall deal with the complaint by sending response to Customer’s e-mail provided in the complaint notification form or in other way determined by the Customer


  1. Seller informs that one needs to maintain the care during washing and follow  washing  instructions.
  2. Washing instructions
  1. clothes should be washed gently, by hand in lukewarm water
  2. one may use powder for manual wash, hair shampoo or washing up liquid
  3. one should not rub too strong clothes when washing
  4. clothes should be gently pressed in water , then  water needs to be squeezed  out  of them
  5. one should stretch  clothes gently to restore them to their original shape
  6. leave them to dry
  7. ironing is possible with steam iron
  1. Seller informs that each Products made from wool is subject to shrinking when washed improperly. Additionally, pressing, rubbing and similar procedures which last too long contribute to shrinking as well.


  1. Customer being at the same time Consumer, who made a remote agreement, may withdraw from it without a reason, submitting a relevant written statement within 14 days. In order to observe the time limit, Customer shall send a statement of withdrawal from an agreement given by the Store.
  2. In the event of withdrawal from the agreement, Sales Agreement shall be deemed unconcluded and the Consumer is released from any obligation. Whatever the parties have furnished shall be returned unchanged, unless the change was necessary within  the ordinary management. Return shall be done immediately, not later than 14 days.
  3. Consumer shall be responsible for decreasing the Product’s value as a result of use in a way exceeding the standard  nature, features and functioning.
  4. Seller shall return the Product’s value along with delivery costs using the same method of payment selected by the Consumer, unless the Consumer has given his explicit consent to other method of return, which does not involve any costs for the account of the Consumer.
  5. If the Consumer has chosen a way of delivering the Product different  than the cheapest, standard method of delivery offered by the online Store, the Seller shall not be responsible for returning additional costs incurred by the Consumer .
  6. Consumer , who withdraws from the Sales Agreement, pursuant to point 1 of this section, shall be responsible only for costs incurred by returning the Product to the Seller.
  7. 14-day withdrawal period starts to count from the day the Consumer receives the Product.
  8. In case of Sales Agreement, whose object of performance is a non-prefabricated item, manufactured according to Consumer’s specification or which aims  to satisfy his individualized needs, the Consumer shall not be liable to withdraw from the agreement.  
  9. Ordered Products which are related to current matters of everyday life, value of which does not exceed 50 PLN are  not subject to exchange or return.


  1. The whole contents available on the website under address www. aeksandrawiniarska.com and Products are subject to copyright protection and are owned by Aleksandra Bartus-Winiarska, place of business and mailing address: 55 Lady’s Cross, Clonakilty, Co. Cork, Ireland. Customer shall be fully responsible for any damage done to Service Provider as a consequence of  using any content of www.aleksandrawiniarska.com website without Service Provider’s consents.
  2. If anyone uses any element making up the contents of www.aleksandrawiniarsa.com website without an explicit, written consent of the Service Provider , such action shall constitute violation of copyrights  of the Service Provider and result in civil and penal liability.


  1. Changes in  the Regulations made by the Service Provider are binding for the Customer provided that he was properly notified of changes and he has not withdrawn from the electronic services agreement within 14 days as of the date of notifying the Customer by the online Store.
  2. Each Customer shall be notified of change in the contents of  the Regulations by placing relevant information regarding change  in the Regulations on the main website of the online Store, containing summary of changes and by keeping such information on the main website for at least 14 consecutive calendar days.
  3. Any dispute arising out of or in connection with Sales Agreement made between the online Store and the Customer shall be decided through negotiations at first, intending to settle a dispute amicably. If such an agreement is not possible or unsatisfactory to Parties, such disputes shall be decided by common court of general jurisdiction.
